At MAZIKIEN, we strive to create a safe and secure environment where you can explore and shop for all your favorite things. All products and information displayed on the website constitute an "invitation to offer." MAZIKIEN reserves the right to accept or reject your offer.

Your order for purchase constitutes your "offer," which shall be subject to the Terms and Conditions as listed below.

 

1. Eligibility to Use Our Site

Persons who are "incompetent to contract," within the meaning of the Indian Contract Act, 1872, including un-discharged insolvents, etc., are not eligible to use the Site. While it's not essential to have an account with us to shop (you can shop as a guest), registering will allow you to:

Thus, MAZIKIEN exclusively owns all such rights, titles, and interests and shall not be limited in any way in its use, commercial or otherwise.

We will be entitled to use, reproduce, disclose, modify, adapt, create derivative works from, publish, display, and distribute any Comments you submit for any purpose whatsoever, without restriction and without compensating you in any way. MAZIKIEN is and shall be under no obligation (1) to maintain any Comments in confidence; (2) to pay you any compensation for any Comments; or (3) to respond to any Comments.

You agree that any Comments submitted by you to the Site will not violate this policy or any right of any third party, including copyright, trademark, privacy, or other personal or proprietary right(s), and will not cause injury to any person or entity. You further agree that no Comments submitted by you to the site will be libelous or otherwise unlawful, threatening, abusive, or contain obscene material, software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam.”

We do not regularly review posted comments, but we do reserve the right (but not the obligation) to monitor and edit or remove any comment submitted to the Site. You grant MAZIKIEN the right to use the name that you submit in connection with any of the posted comments. You agree not to use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of any Comments you submit. You are and shall remain solely responsible for the content of any comments you make, and you agree to indemnify MAZIKIEN and its affiliates for all claims resulting from any Comments you submit. We take no responsibility and assume no liability for any comments submitted by you or any third party.

 

5. Accuracy of Content and Product Information

 

While we strive to provide accurate product and pricing information, typographical errors may occur. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, MAZIKIEN shall have the right, at our sole discretion, to modify the price or information of the products, or to refuse or cancel any orders placed for that product, unless the product has already been dispatched.

 

6. Order Acceptance

 

Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. If your order is canceled after your credit card has been charged, the said amount will be reversed back into your credit card account.

 

7. Cancellation Policy

 

Once an order is confirmed on Mazikien, we are generally unable to cancel it. This is because each order incurs immediate charges related to our platform, payment gateway, and digital marketing efforts. We encourage you to review your order carefully before confirming your purchase.

 

8. Quality Error Request / Returns & Exchanges

 

Please notify us of any quality issue or manufacturing defect in a product within 42 hours of receiving the order.

In case the product has a manufacturing defect or a wrong product has been received, kindly email wecare@mazikien.com within 42 hours of receiving the products. Your email should contain comprehensive details of the defects/complaints of the product delivered to you, along with clear photographs if possible. Our principal designer will verify the manufacturing defects, and our customer service team will then email or contact you for the necessary action, which may include a return, exchange, or refund, subject to our discretion and verification. Beyond 42 hours, no request will be taken into consideration for quality issues or manufacturing defects.

Please note that for any other reasons (e.g., change of mind, incorrect size ordered by customer), returns or exchanges are generally not accepted unless explicitly stated otherwise for specific products or promotions. Any accepted returns or exchanges for reasons other than manufacturing defects will be subject to our discretion and may incur processing fees or shipping charges. Products must be returned in their original condition, unused, with all tags and packaging intact.

 

9. Intellectual Property Rights

 

All content included on the Site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of MAZIKIEN or its content suppliers and protected by Indian and international copyright laws. The compilation of all content on this site is the exclusive property of MAZIKIEN and protected by Indian and international copyright laws.

 

10. Trademarks

 

The MAZIKIEN name and logo, and all related product and service names, design marks, and slogans are the trademarks or service marks of MAZIKIEN. All other marks are the property of their respective companies. No trademark or service mark license is granted in connection with the materials contained on this Site.

 

11. Indemnification

 

You agree to defend, indemnify, and hold harmless MAZIKIEN, its employees, directors, officers, agents, and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses, including attorney's fees, caused by or arising out of claims based upon your actions or inactions, which may result in any loss or liability to MAZIKIEN or any third party including but not limited to breach of any warranties, representations or undertakings or in relation to the non-fulfillment of any of your obligations under this Terms & Conditions or arising out of the violation of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights. This clause shall survive the expiry or termination of this User Agreement.

 

12. Limitation of Liability

 

In no event shall MAZIKIEN be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without way of limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Site, with the delay or inability to use the Site or related services, the provision of or failure to provide services, or for any information, software, products, services and related graphics obtained through the Site, or otherwise arising out of the use of the Site, whether based on contract, tort, negligence, strict liability or otherwise, even if MAZIKIEN has been advised of the possibility of damages.

 

13. Governing Law and Jurisdiction

 

These Terms & Conditions shall be construed in accordance with the applicable laws of India. The Courts in Thane, Maharashtra, India shall have exclusive jurisdiction in any proceedings arising out of this agreement.

 

14. Severability

 

If any part of these Terms & Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Terms & Conditions shall continue in effect.

 

15. Entire Agreement

 

Unless otherwise specified herein, these Terms & Conditions constitute the entire agreement between the user and MAZIKIEN with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and MAZIKIEN with respect to the Site. MAZIKIEN’s failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches.
